According to § 90 Telekommunikationsgesetz (TKG) it is punishable to manufacture, distribute and own transmitters which are disguised as everyday objects in order to take pictures of others unnoticed. It is a transmitting station if it can receive as well as transmit. Thus hidden cameras with WLAN transmission or other radio connection fall into this category. At present, however, only mini cameras with a radio module fall under § 90 TKG. The Federal Network Agency has tightened up controls and, if discovered, sellers and buyers must destroy the products with proof. In addition, a violation will be prosecuted under criminal law. On the other hand, pure receivers that record exclusively are not a transmitter and are therefore permitted. Furthermore, uncamouflaged systems are permitted, which can only be placed discreetly and inconspicuously due to their minimal size. Of course, objects that are clearly used for monitoring purposes, such as baby monitors, are excluded from § 90 TKG.
